Seminars  2009 - 2010 Terms of Registration

Important Seminar Policies and Details (Effective August 8, 2009)

Tuition, Discount and Payment Policies

Early Pay Registration Tuition (savings up to 32 percent):  Standard Registration Tuition is $750 per student, per seminar day, but generous tuition discounts apply when tuition payments are received by the Early Pay Discount Cut-Off Date (see location-specific dates in the table below).  The Early Pay Discount increases with the number of seminar days attended by each student:

  • A Good Deal . . . Attend Any One Day (save 8 percent)  For any student attending one seminar day, discounted Early Pay Tuition is $690 per student, per seminar day.
  • A Better Deal . . . Attend Any Two Days (save 16 percent)  For any student attending two seminar days, discounted Early Pay Tuition is $630 per student, per seminar day.  [In other words, the incremental cost to add a second seminar day is only $570.]
  • The Best Deal . . . Attend All Three Days (save 32 percent)  For any student attending all three seminar days, discounted Early Pay Tuition is $510 per student, per seminar day.  [In other words, the incremental cost to add a third seminar day is only $270.]

Please understand that each seminar's Early Pay Discount Cut-Off Date is strictly applied, and one day late is one day too late to qualify for the above discounts (we offer the strong incentive of the Early Pay Discounts because paid early registrations allow us to efficiently contract our meeting space and catering commitments for each seminar location).

Standard Registration Tuition:  For paid registrations received after the Early Pay Discount Cut-Off Date (and for any Early Pay Discount tuition payment received after the corresponding payment due date), Standard Registration Tuition of $750 per student, per seminar day applies.

Manual Registration Processing Surcharge:  A $50 processing surcharge will be added to the applicable daily tuition rates quoted above when a registration is received by fax, mail or email (because "offline" registrations require manual processing by Earthwork Software Services).  Registering online is safe, quick and easy . . . plus online registrants receive immediate confirmation of seat availability and an instant online invoice.  Unless you have a phobia about using the internet, we encourage you to save yourself some money and take advantage of our online registration system.

Returned Payment Fees and Procedures:  In the case of tuition payments made by paper check, Earthwork Software Services may impose a $50 service fee if a seminar registrant's paper check payment is returned/rejected due to non-sufficient funds.  In the case of tuition payments made by eCheck ACH Electronic Funds Transfer, Electronic Clearing House, Inc. (Earthwork Software Services' eCheck payments processor) may impose a collection fee if a seminar registrant's eCheck payment is returned/rejected due to non-sufficient funds (the eCheck collection fee is equal to five percent of the returned/rejected eCheck's face amount).  In either case, if a returned payment delays receipt of valid tuition payment beyond the applicable Early Payment Cut-Off Date, Standard Registration Tuition will apply.  Finally, in the event of a returned/rejected payment, subsequent payment of the registrant's applicable tuition (plus any service/collection fees) must be made by Money Order or Cashier's Check in order to reinstate and confirm the registrant's seminar registration.

Close of Registration:  Registrations are not accepted after a location's Close of Registration Cut-Off date (typically the Friday immediately preceding a location's first seminar date, see location-specific dates in the table below).

Payments:  Please DO NOT send seminar tuition payments before you have registered and received an invoice (online registrants can view/print an invoice immediately and a copy of the invoice is also emailed to the registrant--please contact us if you do not receive your invoice).  Tuition payments must be received by the earlier of any applicable Cut-Off due date (see table below) or 30 days from the date of invoice.  Timely receipt of your tuition payment will (1) confirm your seminar registration, (2) lock in any applicable Early Payment Discount, and (3) guarantee seminar admission.  We do offer a "weekend grace period" if you are registering on a Friday Early Pay Discount Cut-Off date (as long as we receive your tuition payment no later than the Monday immediately following that seminar's Early Pay Discount Cut-Off date, we will honor the discounted tuition shown on the corresponding invoice, and the "grace period" will be noted on your invoice).

Because our seminars have limited seating, unpaid registrations are subject to cancellation after the invoice's payment-due date (if your registration is cancelled for non-payment of tuition, you will receive a cancellation notice via email). Please understand that seminar admission will be denied to unpaid/cancelled registrants.

Tuition is quoted, and payable, in U.S. dollars exclusive of any applicable sales, use or value-added taxes.  Payment may be made by check or money order, payable to "Earthwork Software Services, LLC" and sent to: 112 Wisteria Way, Stockbridge, GA 30281 USA.  Earthwork Software Services is not affiliated with the software manufacturer (AGTEK) and we cannot accept checks payable to "AGTEK".

eCheck Notification:  When you pay your tuition invoice by eCheck ACH (Automated Clearing House) Electronic Funds Transfer, you authorize Earthwork Software Services either (1) to process a one-time electronic funds transfer (ACH debit) for the invoiced amount from your bank account or (2) to use the eCheck information you submit to produce a paper draft for the invoiced amount that may then be processed like a paper check, or as a one-time electronic funds transfer (ACH debit), from your bank account.  Any electronic transfer will be listed as such on your bank statement.  Your eCheck ACH Electronic Funds Transfer payment will be securely processed by Electronic Clearing House, Inc.  Electronic check payments are an increasingly common payment method and additional information about them is available at www.electronicpayments.org.

Credit Card Payments:  Unfortunately, due to an increased number of transaction problems (unjustified "chargebacks"), we no longer accept tuition payments via credit card.  If you need to make a quick payment because of an approaching Early Pay Discount Cut-Off Date, please pay your tuition by "eCheck" Electronic Funds Transfer or by sending a paper check via a next-day delivery service.

Seminar Admission Notice:  Please understand that seminar admission is granted only to students for whom full tuition payment has been received by Earthwork Software Services.  Registrant's can verify their payment status 24/7 online via our Customer Support page.  It is the registrant's responsibility to do whatever it takes (such as instructing their accounting department to generate a hand-written check that is sent via next-day delivery) to make sure that their tuition payment is received no later than the corresponding Cut-Off Date (or 30 days from date of registration, if earlier) for the student's chosen seminar:

Cancellation, Refund and Transfer of Registration Policies

Cancellation by Earthwork Software Services  If a seminar is cancelled by Earthwork Software Services, registered students will receive a 100 percent refund of their paid tuition.  Although seminar cancellations are rare, Earthwork Software Services cannot be responsible for the cost of any non-refundable travel arrangements that registrants may have made for a cancelled seminar.  Before making non-refundable travel arrangements for any seminar, please contact us to check the seminar location's registration status.

Cancellation by the Attendee  Students canceling at least 30 calendar days in advance of their first seminar date will receive a refund of their paid tuition, less a 10 percent service charge.  Tuition is nonrefundable for students canceling within 30 calendar days of their first seminar date; however, the following options are available:

  • Seminar registrations can be transferred to another member of a registered student’s business organization (there is no charge for this option; just tell us the name of the alternate attendee so we can have a name tag ready for them at the seminar).
  • Seminar registrations can be transferred, on a space-available basis, from one seminar location/date to another seminar location/date within the current seminar season (a service charge equal to 20 percent of the registrant's paid tuition applies).  This option is NOT available for "NO SHOWS" -- we must be advised (by phone, fax or email), before the seminar begins, that the registered student will not be attending the seminar.
  • If neither of the above registration transfer options meet the cancelling student's needs, a tuition credit (paid tuition, less a 20 percent service charge) can be applied to any next-season seminar conducted within one year (365 calendar days) of the seminar date(s) for which the student was originally registered.  Seminar tuition may increase from one seminar season to the next and the cancelling student will be required to pay the difference between their tuition credit and the then current tuition for the future seminar that they may choose to attend.  The tuition credit can be used by any employee of the cancelling student's business organization; however, the tuition credit is non-transferable in all other respects.  Finally, there is no guarantee that identical seminar courses and/or identical geographic seminar locations will be scheduled from one seminar season to the next.  This option is NOT available for "NO SHOWS" -- we must be advised (by phone, fax or email), before the seminar begins, that the registered student will not be attending the seminar.

Popular Seminars Fill Up and Sell Out

We reserve the right to reject registrations when a seminar has reached its full capacity (seating is limited at each location).  Register as early as possible to avoid any disappointment (registrations are processed on a "first-come, first-served" basis).

Unpopular Seminars are Cancelled

We reserve the right to cancel a seminar when too few registrations are received (a minimum of seven students per day is typically required to support a seminar).  Cancellation decisions are typically made near each seminar location's Early Pay Cut-Off Date, based on the number of paid registrations received through that date.  (Registering as early as possible helps insure that your chosen seminar location will not be cancelled!)

Correctly Identify Your AGTEK Product

Because Earthwork Software Services does not know which AGTEK products our seminar registrants may own and use, it is imperative that prospective seminar attendees correctly identify their AGTEK products to insure that they register and attend the appropriate seminar(s).  The surest way to identify an AGTEK product is to start the AGTEK program and select Help > About... from the program's pull-down menu, which will produce a window identifying the name, version number and release date of the product.  Otherwise, examine the product manuals delivered with your AGTEK system or call AGTEK at (925) 606-8197 and ask them to check their database to identify the AGTEK product.  Please understand that tuition credits/refunds WILL NOT be extended to students who attend the "wrong" seminar.

Consider the Attendee's Experience and the Seminar Prerequisites

It is assumed that all seminar attendees have a basic understanding of earthwork concepts and that they know how to read grading plans.  For those attending the seminars only to make a product purchase evaluation, or only to understand what the products are capable of doing, no other prerequisites apply.  However, these fast-paced, lecture/demonstration style seminars are designed to take other attendees (those who are "hands-on" users of the products) well beyond the basic training provided to them by AGTEK at the time of purchase.  For hands-on users, the following prerequisites also apply:

Day 1:  Some hands-on experience with Earthwork 3D, SitePlan 3D, SiteModel 3D, or GradeModel 3D is strongly recommended.  Students with no prior experience on these products may be overwhelmed by the volume and detail of information presented, especially if they will also be registering for the Day 2 and/or Day 3 seminars (for new users with no prior experience, AGTEK's hands-on training options may be a more appropriate introduction to the products).

Day 2:  Proficiency with the Day 1 "Earthwork Modeling Step-by-Step" topics is strongly recommended.

Day 3:  Proficiency with the Day 1 "Earthwork Modeling Step-by-Step" topics is strongly recommended.

Seminar Registration Confirmation/Invoice Displayed in Pop-Up Window

The Earthwork Software Services web site uses a pop-up window to display your registration confirmation and invoice (and a lot of other useful information too), but pop-up blockers on your computer will prevent you from viewing and printing this information.  To insure that you can view/print your seminar registration confirmation and invoice, please set your web browser and internet security software to allow this site's pop-up windowsConsult our pop-up blocker tips page or your company's IT Manager if you have any questions regarding disabling your pop-up blockers.

Important Seminar Registration Notifications Sent by Email

Earthwork Software Services relies on email to quickly deliver critical information to you regarding your seminar registration (registration confirmation/invoice, venue announcements, late-payment notices, and registration cancellation notices).  Assuming that you provide a valid email address when registering, the Number One reason that will prevent you from receiving our email notices is the use of overly-aggressive SPAM filters on your organization's email server and/or on your local computer.  To insure that you do receive the email notices that we send to you, please set your SPAM filters to accept email sent by "EarthworkSoftwareServices.com" (our email notices will always include the word "AGTEK" in the Subject Line)Consult our email tips page or your company's IT Manager if you have any questions regarding settings for your particular SPAM filters.
